In using this website or mobile application, you, the Guest, are deemed to have read and agreed to the following terms and conditions:

The following terminology applies to these Terms and Conditions, Privacy Notice & Policy and any or all Agreements. "Guest", “You” and “Your” refers to you, the person accessing this website and affiliated mobile application, and accepting the Company’s terms and conditions. "The Company", “Ourselves”, “We” and "Us", refers to our Company, Whatscookn “Party”, “Parties”, or “Us”, refers to both the Guest and ourselves, or either the Guest or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Guest in the most appropriate manner for the express purpose of meeting the Guest’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing applicable Laws of UAE. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

  2. Confidentiality
    1. Guest records are regarded as confidential and therefore will not be divulged to any third party, other than our marketing vendor or if legally required to do so to the appropriate authorities.
    2. Guests undertake not to divulge the personal data or information of Hosts at whose venue where they dine.
    3. If a Guest has recorded by way of a video or taken aphotograph of the Host or the Host’s venue where the hosting takes place (“Host Venue”), the Guest undertakes not to disclose nor disseminate any photograph or video taken of the service for which the Guest pays and which takes place at the Host Venue save for security purposes or investigation conducted by the proper authorities.

  3. Cancellation Policy
    1. When a Guest wishes to cancel a confirmed booking prior to the fulfilment of service, the cancellation policy as appended will apply.
    2. Discounts applied via credits/promo codes are not refundable in cash.
    3. A booking shall be deemed cancelled only upon receipt of Whatscookn’s confirmation of your cancellation. Whatscookn reserves the right to cancel a booking at any time with full refund of the booking amount to the Guest.
    4. Should a Host cancel a confirmed booking, Whatscookn will refund the Guest the full booking amount paid by the Guest, regardless of the lead time towards fulfilment date. Whatscookn reserves the right not to refund the Host any amount, as a result of his/her cancellation. An email will be sent to the Guest to inform him/her of the cancellation.
    5. Whatscookn reserves the right to withhold and subsequently forfeit the full booking amount to the Host, upon the receipt of a mitigated complaint by aGuest with respect to the booking, it believes, at its sole discretion, that such booking was not compatible with Whatscookn’s standards of service or in the case of any misconduct by the Host.
    6. When a Guest cancels 4 bookings within 30 days, Whatscookn may deactivate the Guest's account.
    7. Any bookings that the Guest has can be cancelled; Guest may not be entitled to any compensation for the bookings that were cancelled as a result of his / her suspension. Whatscookn may also:
      1. Communicate to the appropriate hoststhat their booking was cancelled.
      2. Compensate hosts in full, regardless of the cancellation policy
    8. Whatscookn shall not bear any liabilityfor any cost, expense, loss or damage that the Host or Guest may suffer or incur, as a result of either party’s cancellation of a booking.

  4. Disclaimer, Exclusions and Limitations
  5. The information on this website is provided on an "as is"basis. To the fullest extent permitted by law, Whatscookn:
    1. Excludes all representations and warranties relating to this website and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this website and/or the Company’s literature.
    2. Excludes all liability for damages arising out of or in connection with your use of this website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised this Company of the possibility of such potential loss), damage caused toyour computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.
    3. Excludes any responsibility that the Guest must have the right to use the place to receive a service, e.g. Chef for Hire.
    4. Excludes any responsibility for ensuring that the Hosts complete the Host Service; the conduct of theHost, the health of the Host; the state and quality ofthe meal provided by the Host.
    5. Excludes any or all loss and damage that the Guest may suffer as a result of the Host Service particularly, loss and damage to the moveable or immoveable property in the possession of the Guest.
    6. Endeavours to perform the checks on a Host via the particulars given by Host but does not assure nor guarantee the quality of meal prepared by Host, thecharacter of Host, the ambience of Host Venue and advises Guest to exercise due diligence.

  6. Acceptance & Termination of Guest Agreement
    1. A Guest is deemed to have accepted the terms of this Agreement with Whatscookn after filling in all required details and clicking the ‘Book & Pay’ button upon checkout.
    2. A Guest may terminate this Agreement by giving Whatscookn an email notice seven (7) days before the date termination is expected to commence (“Termination Date”).
    3. If there are any arranged Host Service to take place after the Termination Date, the Guest agrees to the Cancellation Policy.
    4. Host Booking
      1. Once the Guest accepts the Host’s offer of a Host Listing and makes payment via our mobile application or website (“Host Booking”), the Host Booking is confirmed.
      2. For cancellations not initiated by Guest, Guest is entitled to a full refund.
      3. Whatscookn has no control over the conduct of hosts and disclaims all liability. Failure of hosts to satisfy theirresponsibilities may result in suspension of activity or removal fromWhatscookn's website and app.

  7. Undertaking by Guest
    1. Guest undertakes that all information rendered by Guest for purposes of entering into this Guest Agreement with Whatscookn is true to the best of the knowledge of the Guest at time of disclosure.
    2. Permissible age as an independent Guest is 18 years old.
    3. Guests under 18 years old will require parental consent or companionship by an adult above 18.
    4. Guest undertakes to conduct himself / herself in an appropriate manner at the Host Venue during the Host Service.
    5. Legal drinking age in UAE is 18 years old and the Guest should adhere to the law when considering consumption of alcoholic beverages.
    6. Guest undertakes to take precaution and care during his / her attendance at the Host Service and ensure that he / she will not cause any damage or loss to the property or assets at the Host venue.
    7. Guest accepts that if there is any change that may render the Guest Event Offer different, such as the Host being taken ill and having to cancel the Host Service; Whatscookn or the Host will inform Guest by way a text message, a phone call or an email as soon as Whatscookn receives news of such changes.
    8. If there is any ingredient offered as a part of the farein the Guest Event that is known to the Guest to be a source of his / her allergy, Guest undertakes to disclose his / her allergy to the Host. Guest further waives any right of claim or indemnity from Whatscookn if Guest suffers from an allergy attack or becomes unwell after consuming food offered by Host at the Host Service.
    9. Guest undertakes to inform Whatscookn as soon as possible if Guest has an adverse experience with a Host at a Host Service.
    10. Should there be 4 booking cancellations within 30 days by the Guest, Whatscookn reserves the right todeactivate the Guest account and future bookings immediately.

  8. Payment
  9. Payment must be made immediately by Guest at the point of accepting the Host Booking on our website or mobile application by way of the methods of payment available at our website and mobile application.

  10. Other Terms
    1. Log Files
      1. We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URLrequested, and referral URL. This information is not shared with third parties and is used only within thisCompany on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.
    2. Cookies
      1. Like most interactive websites, this Company’s websites [or ISP] uses cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate partners may also use cookies.

    7. Force Majeure
      1. Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to anyforce majeure event, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civilor military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which couldhave been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavoursto comply with the terms and conditions of any Agreement contained herein.
    8. Waiver
      1. Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
    9. General
      1. The laws of UAE govern these terms and conditions. By accessing this website and using our services you consent to these terms and conditions and to the exclusive jurisdiction of the UAE courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions andany Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorised representatives of the Company.
    10. Notification of Changes
      1. The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers’ Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change.
